01:01 UNIVERSITY STATEMENT OF PRINCIPLES AND PROCEDURES

01:01:01 Academic institutions exist for the transmission of knowledge, the pursuit of truth, the development of students and the general well being of society. Free inquiry and free expression are indispensable to the attainment of these goals. Freedom to teach and to learn depends upon appropriate opportunities and conditions in the classroom, on campus and in the community. Students should exercise their freedom with responsibility.

01:01:02 Implicit in the community’s recognition of the rights and freedom of the individual is an obligation on the part of the individual to accept responsibilities toward the community. The University has a duty to develop procedures and policies which safeguard the freedom to teach and to learn. Responsible and representative government can accept these rules and regulations and/or propose its own rules and procedures which, when implemented, will ensure the collective health, safety, and welfare of its residents and the security and maintenance of University facilities. Such government proposals will be reviewed and accepted or rejected by appropriate student-faculty committees and the University administration.

01:01:03 Although emphasis is placed on counseling and guidance in cases of misconduct, the University may take disciplinary action and/or civil and criminal actions against a person disrupting campus activities in order to ensure the collective good of the community and to protect the rights of its members. The authority of the University includes dismissing a student whose conduct is unsuited to the purpose of the institution.

01:02 BOARD OF REGENTS POLICY

The Regents support the University President with respect to student behavior. The board is committed to the support of students' constitutional rights, but also has an obligation to protect the institution's educational purpose. Students are subject to all federal, state and local laws, as well as to campus rules and regulations, and students are subject to disciplinary action for breach of laws and regulations. Members of the academic community are expected to be familiar with the laws, rules and regulations. Changes in rules may be desirable from time to time. Student participation in bringing about changes through appropriate channels is encouraged. The rules in this article apply to the campus of South Dakota State University and the members of the academic community of South Dakota State University.

01:03 CODE AUTHORIZATION AND CHANGE PROCESS

The SDSU Student Code is authorized by SDSU, which in turn, is authorized by the South Dakota Board of Regents through Board Policy No. 3:4. Changes in the SDSU Student Code may be initiated by referendum according to Student Association Bylaws; or by the Student Affairs Committee. Approval of proposed changes in Code items which are not Regental regulations requires Student Committee, Academic Senate and University President concurrence. Approval of proposed changes in Code items which are also Regental regulations requires a public hearing and Student Senate, Student Affairs Committee, Academic Senate, University President and Board of Regents; concurrence. The Student Code shall be reviewed every four (4) years under the direction of the judicial officer.
